1. General

These terms and conditions apply to the free use of the ARON software for test purposes. Any terms and conditions of the customer that conflict with or deviate from these terms and conditions shall not apply. Subsidiary agreements, amendments or supplements must be made in writing. Fraunhofer reserves the right to offer the software to other customers. 

The ARON tool uses the following open source Python libraries:  pvlib (pvlib documentation), pandas (pandas main page), numpy (numpy main page), matplotlib (matplotlib main page), SciPy (scipy main page), Tkinter (tkinter main page), configparser (configparser main page), screeninfo (screeninfo main page).

2. Rights of use

Fraunhofer grants the customer the simple (non-exclusive) and time-limited right to use the ARON software described in more detail on this website free of charge for test purposes only in accordance with the following provisions. The transfer of the software does not imply any granting of rights beyond the following provisions. In particular, the Fraunhofer-Gesellschaft (FhG) reserves all distribution, exhibition, demonstration, performance and publication rights to the software.

Unless otherwise agreed in writing, the customer is only authorised to use the software on one piece of hardware, i.e. on one screen at one location and only for test purposes (single-user use). If the customer changes the hardware, he must delete the software from the mass memory of the previously used hardware. Simultaneous storage, provision or use on more than one piece of hardware is not permitted. Use of the software within a network or other multi-station computer system is only permitted if this does not create the possibility of simultaneous multiple use of the software. Furthermore, the software may not be used via remote data transmission.

The customer may only reproduce the software if the reproduction is necessary for the use of the software. Necessary reproductions include the installation of the software from this website onto the mass storage device of the hardware used, insofar as this is not prevented by the copy protection, as well as loading the software into the working memory. If this is necessary to ensure the future use of the software in accordance with the contract, the customer may also make a backup copy of the software. Otherwise, the customer is not authorised to make copies. This also applies to the duplication of parts of the software and to the - complete or partial - duplication of the enclosed documentation.

The retranslation of the programme code into other code forms (decompilation) and other types of reverse engineering of the various production stages of the software are only permitted within the framework of §69e of the German Copyright Act.

The customer is not permitted to lease the software and the accompanying documentation for commercial purposes. Furthermore, the customer shall only be entitled to pass on the software and the enclosed documentation if third parties agree in writing to the continued validity of the licence conditions of this Clause 2 and the customer hands over or deletes all copies of the program to the third party. The customer's right to use the programme shall expire upon transfer. The customer is obliged to inform FhG of the name and full address of the third party.

The customer is not authorised to remove or change copyright notices, serial numbers or other identifying features of the software.

3. Shortcoming

The software is provided free of charge for test purposes only and beyond that. FhG shall not be liable for material defects and/or defects of title in the software. This also applies in particular in the case of only insignificant deviation from the agreed quality, only insignificant impairment of usability, natural wear and tear or damage that occurs after the transfer of risk as a result of incorrect or negligent handling, excessive use, unsuitable operating resources or due to special external influences that are not provided for in the contract. If the customer makes improper modifications, no claims for defects shall exist for these and the resulting consequences. This does not apply to defects that FhG has fraudulently concealed. FhG does not assume any guarantee in accordance with § 443 BGB.

4. Compensation for damages

Claims for damages and reimbursement of expenses by the customer (hereinafter: claims for damages) are excluded, irrespective of the legal grounds, in particular due to breach of duties arising from the contractual obligation and from unauthorised action. This shall not apply where liability is mandatory, e.g. under the Product Liability Act, in cases of wilful intent, gross negligence, injury to life, limb or health, or breach of material contractual obligations. A change in the burden of proof to the detriment of the customer is not associated with the above provisions. However, the claim for damages for the breach of essential contractual obligations is limited to the foreseeable damage typical for the contract, unless there is intent or gross negligence or liability for injury to life, limb or health.

5. Applicable law, partial invalidity

A contract between FhG and the respective customer shall be governed exclusively by German law to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

Should individual provisions of these General Terms and Conditions be or become invalid, this shall not affect the validity of the remaining General Terms and Conditions. The invalid provisions shall be replaced by provisions that come closest to what the contracting parties would have wanted if they had considered the respective circumstance. This also applies to loopholes in these General Terms and Conditions.
